These terms apply to your use of this website and to every order placed with Home of Engine & Transmissions (“we”, “us”), whether online, by WhatsApp, by email or by phone. By using the site or placing an order you accept them. Nothing in these terms limits any right you have under the Consumer Protection Act 68 of 2008 (CPA) or the Electronic Communications and Transactions Act 25 of 2002 (ECTA) that cannot lawfully be limited.

1. Who we are

Home of Engine & Transmissions supplies used, imported and new engines and transmissions and related parts for cars, light commercial vehicles and heavy-duty trucks. 2. Using the website

You may use the site to browse, request quotes and buy from us. You agree not to break any law while using it, attempt to gain unauthorised access to our systems, interfere with the site or its servers, or upload harmful, defamatory or unlawful material. We may suspend or block access for anyone who breaches these terms.

If you create an account, keep your login details private. You are responsible for activity under your account.

3. Product information

We describe our units as accurately as we can, but photographs may show a similar unit and specifications can vary between vehicles. Fitment is confirmed against your VIN or engine code. It remains your responsibility, or your workshop’s, to check compatibility before installation.

4. Quotes and orders

A quote is valid for the period stated on it and is subject to stock still being available.
The information you give us when ordering, including your vehicle details and delivery address, must be correct and complete.
An order is accepted only when we confirm it and receive full payment.

5. Stock availability

Most of our units are one-off items. Stock is sold first come, first served, and a unit is only reserved once it has been paid for in full. If a unit sells before your payment clears, we will offer an alternative or refund your payment in full.

6. Prices and payment

All prices are in South African rand (ZAR) and include VAT at the current rate.
All prices include 15% VAT. Delivery to an address in South Africa is free on orders of R50,000 and above, including VAT. Other deliveries are quoted separately for your address unless the quote states otherwise.
We accept EFT and card payments. Full payment is required before a unit is released or dispatched.
We do not offer lay-by, deposits, instalments or other pay-over-time arrangements.
If a price on the site is clearly wrong because of a typing or system error, we will tell you before processing the order, and you may cancel for a full refund.

7. Our right to refuse or cancel

We may decline or cancel an order because of a pricing or stock error, a payment problem, or a reasonable suspicion of fraud. If we cancel after you have paid, we refund the full amount you paid.

8. Delivery, warranty and returns

Delivery is governed by our Shipping and Delivery policy, warranty cover by our Warranty policy, and returns by our Returns and Refunds policy. These policies form part of these terms.

9. Cooling-off for online purchases

Where section 44 of ECTA applies to an online purchase, you may cancel within 7 days of receiving the goods, without reason or penalty, other than the direct cost of returning them. This does not apply to goods made or sourced to your specification where the law excludes them. Goods must be returned unused and in the condition received.

10. Intellectual property

The content on this site, including text, photographs, logos and design, belongs to us or is used with permission. You may not copy, reproduce or distribute it without our written consent.

11. Limitation of liability

To the extent the law allows, we are not liable for labour costs, towing, courier fees, vehicle downtime, rental vehicles, loss of income or other indirect or consequential loss. We are not liable for failures caused by incorrect installation, the wrong part being selected by the buyer, overheating, incorrect fluids or timing, oil leaks or poor maintenance. Our total liability for any claim is limited to the price paid for the unit concerned. This clause does not exclude liability for our gross negligence or any liability that cannot be excluded under the CPA.

12. Links to other websites

The site may link to third-party websites. We are not responsible for their content or how they handle your information.

13. Changes to these terms

We may update these terms from time to time. The version on the site when you place an order applies to that order.

14. Governing law

These terms are governed by the laws of the Republic of South Africa, and South African courts have jurisdiction over any dispute.
